What happened

Tenants applied for an order determining that the Landlords failed to meet maintenance obligations following a sewage backup. The Tenants, who own a mobile home in the Landlord's park, experienced a sewer blockage that caused sewage to eject onto their lawn. They claimed the backup was caused by gravel entering an unsealed pipe during previous construction work known to the Landlord. The Tenants sought reimbursement for the emergency repair costs they incurred.

The ruling

The Tenant's application was dismissed. The Board found that the Tenant did not sufficiently prove that the Landlord breached their maintenance obligations under the Residential Tenancies Act. While the sewer backup was unfortunate, the Landlord's previous maintenance actions and lack of knowledge of the debris meant they did not act unreasonably.
