What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant, a seasonal mason and father of four, experienced financial hardship after his partner left and he was out of work. Since the application was filed, the Tenant made significant efforts to pay down arrears, contributing $4,125.00. The adjudicator considered the Tenant's circumstances and granted a postponed eviction to allow him the opportunity to preserve the tenancy by paying the remaining balance.
The ruling
The tenancy is ordered terminated effective July 31, 2025, unless the Tenant voids the order by paying the specified arrears. To continue the tenancy, the Tenant must pay $4,891.00 by June 30, 2025, or $6,460.00 by July 31, 2025. If the tenancy is terminated, the Tenant is ordered to pay the Landlord $2,630.07 (which accounts for recent payments and the rent deposit credit) plus daily compensation of $51.58 starting from June 19, 2025.
