What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served a valid N4 Notice, but the Tenant did not void the notice by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing, which was held by videoconference. Only the Landlord attended the hearing.

The ruling

The Landlord's applications to terminate the tenancy for non-payment of rent and persistent late payment of rent were granted. The Tenant must vacate the rental unit by September 21, 2024 and pay the Landlord $8,000.48 in rent arrears and application costs, minus the rent deposit and interest. If the Tenant does not pay the full amount by the due date, they will owe interest on the outstanding balance.
