What happened
The Landlords applied for termination of tenancy and eviction based on non-payment of rent and failure to pay utilities. The Tenants acknowledged the arrears but cited financial hardship and the presence of three children in the home (ages 15, 9, and 5) as reasons for requesting a delay in the eviction. The Landlords argued financial prejudice but the Board found that a postponement was warranted to allow the family time to secure alternative housing while ensuring the Landlords received a judgment for the significant arrears.
The ruling
The tenancy is terminated effective June 30, 2025, unless the Tenants pay $23,986.00 to void the order. If the Tenants do not void the order, they must move out by June 30, 2025, and pay the Landlords $13,459.48 for rent-related arrears and $2,062.00 for utility arrears, totaling $15,521.48. Daily compensation of $111.78 applies for each day the Tenants remain past April 29, 2025.
