What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant disputed being served the N4 Notice, but the Landlord testified that it was served by placing it under the Tenant's door.
The ruling
The tenancy is terminated unless the Tenant pays $30,206 by May 17, 2023 or $33,206 by May 22, 2023 to void the order. If the Tenant does not void the order, they must vacate the unit by May 22, 2023 and pay the Landlord $20,967.64 plus daily compensation of $98.63 from February 15, 2023 until the move-out date.
