What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant, experiencing health issues that impacted his income as a self-employed individual, requested relief from eviction and a payment plan. The Landlord argued that the Tenant had not attempted to negotiate prior to the hearing and believed the request was a delay tactic.
The ruling
The LTB granted the Tenant relief from eviction on the condition that he follows a strict payment plan. The Tenant must pay July 2025 rent by July 29, 2025, and pay the total arrears of $3,466.00 through a schedule of monthly payments starting August 1, 2025, through April 1, 2026. If the Tenant misses any payment, the Landlord may apply for an ex parte eviction order.
