What happened
The Tenants requested a review of an order that terminated their tenancy and ordered payment for utility costs. The Tenants failed to attend the original hearing on August 6, 2025, claiming they forgot the date after receiving a sheriff's notice the previous day. The Landlords attended and provided uncontested evidence. The review request was assessed to determine if the Tenants were reasonably able to participate and if a serious error occurred.
The ruling
The request to review the original order (LTB-L-020322-25) was denied. The LTB found that the Tenants' failure to attend the hearing due to forgetting the date was not a sufficient excuse. The original order, which terminated the tenancy and required payment for utilities, remains in full effect.
