What happened
The Landlords applied to terminate the tenancy and evict an Unauthorized Occupant after the original Tenants passed away. The original Tenant passed away in October 2023, but the Landlords were not notified until September 2024. The son of the deceased Tenant remained in the unit and claimed he thought he was a tenant because he had put the utilities in his name. The Landlords sought possession and compensation for use of the unit.
The ruling
The LTB ruled that the tenancy was legally terminated 30 days after the original Tenant's death in 2023. The Unauthorized Occupant (the Tenant's son) must vacate the unit by July 31, 2025. He is ordered to pay $1,720.82 to the Landlords for daily compensation and filing fees, plus an ongoing daily rate of $28.26 until he vacates.
