What happened

The Landlord applied for an ex-parte order to evict the Tenant for breaching a condition of a previous LTB order by paying January 2025 rent late. An eviction order was issued without a hearing. The Tenant filed a motion to set aside this eviction order. The Tenant admitted to paying rent late for several months due to financially supporting family from Sudan but stated rent was now paid in full. The Board granted the Tenant's motion, set aside the eviction order, and gave the Tenant a final chance to pay rent on time for the next 12 months under a new conditional order.

The ruling

The Tenant's motion to set aside a prior eviction order, which was issued for late rent payment in breach of a previous order, is granted. The eviction order is voided. A new conditional order is issued, requiring the Tenant to pay rent in full and on time for 12 months, from May 2025 to April 2026. If the Tenant breaches this condition, the Landlord can apply for eviction without a new hearing.
