What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served a valid N4 notice which the Tenant failed to void by the termination date. Although the Tenant did not attend the hearing, evidence showed that the Tenant had made substantial payments totaling $2,441.18 since the application was filed, though a balance remained.
The ruling
The tenancy is terminated effective October 4, 2025, unless the Tenant voids the order. To void the order and continue the tenancy, the Tenant must pay $1,437.18 by September 30, 2025, or $2,657.77 by October 4, 2025. If the tenancy is terminated, the calculation as of the hearing date shows the Landlord actually owes the Tenant $326.25 after applying the rent deposit and interest, though daily compensation of $40.13 applies for each day the Tenant remains after September 11, 2025.
