What happened
Tenant applied for an order determining that the Landlords collected or retained money illegally. The Tenant alleged the Landlords expressed concerns about cooking smells from the basement unit and requested the Tenant to limit cooking and open windows. The Tenant decided to vacate the unit early and provided an N11 Agreement to End the Tenancy, but the Landlords did not reimburse the Tenant for the rent paid for the period after the Tenant vacated.
The ruling
The Landlords must pay the Tenant $999.80, which includes $946.80 for excess rent collected and $53.00 for the cost of filing the application. The Landlords must pay the full amount by January 21, 2024, after which interest will accrue.
