What happened

The Landlord applied to terminate the tenancy because the Tenants allegedly failed to meet conditions set in a previous LTB order (June 13, 2024). An eviction order was initially issued on January 31, 2025, without a hearing. The Tenants filed a motion to set aside that order. During the hearing, both parties reached a consent agreement to set aside the eviction and establish new payment conditions.

The ruling

The LTB granted the Tenants' motion to set aside a previous eviction order. By consent, the parties agreed that the Tenants will remain in the unit provided they pay the full rent on time beginning May 1, 2025, through April 30, 2026. If the Tenants fail to make any payment, the Landlord may apply for an eviction order without further notice to the Tenants.
