What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant failed to attend the hearing despite being properly served with notice. The Landlord provided evidence that the Tenant owed significant arrears and had not responded to a repayment plan proposal sent via email prior to the hearing.

The ruling

The tenancy is terminated effective January 4, 2026, unless the Tenant voids the order by paying the full arrears and costs. If the Tenant does not void the order, they must vacate by the termination date and pay the Landlord $1,529.08 (arrears adjusted for payments and deposit) plus $77.89 per day for compensation until they move out.
