What happened

The Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant claimed that she paid August 2024 rent in error and that the last month's rent deposit should have been applied to that month. The Landlord argued that the parties had mutually agreed to extend the tenancy to September 30, 2024, and therefore the deposit was correctly applied to September. The Landlord also noted that the Tenant did not return the keys until mid-September.

The ruling

The Tenant's application for the return of rent money was dismissed. The Board found that the Tenant had requested and was granted an extension of the tenancy to September 30, 2024. Consequently, the Landlord acted lawfully by applying the rent deposit to the month of September rather than August.
