What happened

Tenant applied for an order determining that Landlord has collected or retained money illegally. The original order found that the Landlord applied the Last Month's Rent deposit to the last month's rent, which the Tenant did not pay. The Tenant requested a review, providing new evidence that he had paid the October 2022 rent, and the Landlord had cancelled the transfer of the Last Month's Rent deposit.

The ruling

The Landlord is ordered to pay the Tenant the Last Month's Rent deposit of $1,210.00, as well as the $53.00 costs of the original application, and the LTB shall refund the $58.00 review application fee to the Tenant. If the Landlord does not pay the full amount by April 5, 2024, the amount will accrue interest at 7% annually starting April 6, 2024.
