What happened
The Tenant applied for an order claiming that the Landlord and Superintendent entered the unit illegally, harassed the Tenant with name-calling, and failed to address maintenance issues including kitchen tiles, a sagging ceiling, and plumbing problems. The Landlord argued that the Tenant obstructed access for inspections and repairs by installing a second lock without providing a key and refusing entry on scheduled dates.
The ruling
The Tenant's application (T2/T6) is dismissed in its entirety. The adjudicator found that the Tenant did not provide sufficient evidence to support the claims of harassment, illegal entry, or maintenance negligence. Crucially, it was found that the Tenant hindered the Landlord's efforts to inspect and repair the unit by installing unauthorized locks and refusing entry.
