What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's son.

The ruling

The tenancy is terminated effective May 6, 2023. The Tenant must move out by that date. The Tenant owes the Landlord $9,074.44, which represents compensation for use of the unit from November 21, 2022 to April 4, 2023, less the rent deposit and interest owed to the Tenant. The Tenant also owes the Landlord $87.12 per day for use of the unit from April 5, 2023 until the Tenant moves out. The Landlord must pay the Tenant one month's rent as compensation for the N12 notice.
