What happened

This is a third review request regarding an order to terminate a tenancy for non-payment of rent. The Tenant's daughter requested the review, alleging a serious error because she was not named as a tenant in the previous orders. The Tenant claimed her daughter paid half the rent and was recognized as a tenant by the Landlord in past notices. The Landlord countered that he only ever intended to rent to the mother, met her alone, and only received rent from her until a recent ODSP payment. The Board found that the Tenant only raised the daughter's status after facing imminent eviction and had previously filed an application listing herself as the sole tenant.

The ruling

The LTB denied the third review request, confirming the previous order issued on March 18, 2025. The Board found no serious error in failing to name the Tenant's daughter as a co-tenant, determining she was an occupant. All previous stays on the eviction are lifted immediately.
