What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, and the Tenant did not void the notice by paying the rent arrears.

The ruling

The tenancy is terminated effective December 5, 2023 unless the Tenant pays the full amount owing by November 30, 2023 or December 5, 2023. If the Tenant does not void the order, the Tenant must pay $3,123.42 to the Landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenant must also pay daily compensation of $60.39 for each day of occupation starting June 20, 2023 until the Tenant vacates the unit.
