What happened
The Tenant applied for a determination that the Landlord failed to meet maintenance obligations regarding a malfunctioning heating system and a cockroach infestation. The Tenant alleged the heating system was excessively hot (80-90 degrees), forcing her to use space heaters. She also claimed a constant cockroach infestation which the Landlord failed to treat adequately. The Landlord argued that the Tenant refused entry for treatments on multiple occasions and that they followed a treatment regime when allowed.
The ruling
The Landlord was found to have breached maintenance obligations regarding the heating system and pest control. However, due to the Tenant's failure to mitigate damages and her refusal of entry for treatments, only a nominal rent abatement of $200.00 was ordered. Claims for replacement of personal property were dismissed for lack of evidence.
