What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. A valid N4 Notice was served, which the Tenant failed to void. While the Tenant made significant payments after the application was filed, covering new rent, the historical arrears remained unpaid as of the hearing date. The Tenant did not attend the hearing to offer testimony or request relief.

The ruling

The tenancy is terminated unless the Tenant pays $1,019.22 on or before August 17, 2025, to void the order and continue the tenancy. If the Tenant does not pay, they must vacate by August 17, 2025. In the event of termination, the Tenant is ordered to pay the Landlord $401.40 for arrears and filing fees, plus daily compensation of $20.03 from July 31, 2025, until they move out.
