What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. Tenant M.O had vacated the rental unit in February 2023 without notifying the Landlord, while Tenant J.O was still residing in the unit.

The ruling

The tenancy is terminated unless the Tenants pay $7,405 to void the order by November 21, 2023. If the Tenants do not void the order, they must move out by November 21, 2023 and pay the Landlord $4,185.61, which includes rent arrears and application filing fee, minus the rent deposit and interest.
