What happened
The Landlord applied to terminate the tenancy and evict the Tenants for non-payment of rent. The Tenants disputed the total amount, claiming an uncredited payment of $950 from March 2024 and questioning a rent increase. The Board found the arrears to be $12,401.96 but granted relief from eviction based on the long-term nature of the tenancy and the presence of children in the home, setting up a long-term payment plan.
The ruling
The Tenants are ordered to pay $12,587.96 in arrears and costs. However, they are granted relief from eviction provided they pay $500.00 monthly toward the arrears in addition to their regular monthly rent, starting November 1, 2025. If any payment is missed, the Landlord may apply for an ex parte eviction order within 30 days of the breach.
