What happened
The landlord applied for an order to terminate the tenancy and evict the tenant due to non-payment of rent. The tenant requested an adjournment to seek internal reviews of rent-geared-to-income (RGI) decisions, but this was denied as the tenant did not demonstrate reasonable diligence in seeking the reviews. The landlord served a valid N4 notice and the tenant remained in possession of the unit.
The ruling
The tenancy is terminated unless the tenant pays $8,964 by May 29, 2023 to void the order. If the tenant does not pay, they must vacate the unit by May 29, 2023 and pay the landlord $8,456.60 plus daily compensation of $15.45 from April 29, 2023 until move-out.
