What happened
The landlord filed two applications with the Landlord and Tenant Board (LTB) to terminate the tenancy and evict the tenant for non-payment of rent and for the landlord's own use. The LTB ruled in favor of the landlord in both cases. The tenant appealed both decisions to the Divisional Court. The landlord brought a motion to quash the tenant's appeal and lift the stay of eviction.
The ruling
The Divisional Court dismissed the tenant's appeal of the LTB decisions terminating the tenancy and ordering eviction. The court found the appeal to be without merit and lifted the stay of eviction. The tenant was ordered to vacate the property and pay substantial indemnity costs to the landlord.
