What happened
The Tenant applied for an order after the Landlord illegally locked him out of the rental unit for 29 months. The Landlord had argued that the Residential Tenancies Act did not apply to the unit, but this was overturned by the LTB and the Divisional Court. The Tenant sought rent abatement, reimbursement of out-of-pocket expenses, and an administrative fine against the Landlord.
The ruling
The Landlord is ordered to pay the Tenant $11,256.54 by October 26, 2025, for out-of-pocket expenses and the application fee incurred due to a 29-month illegal lockout. Additionally, the Landlord must pay an administrative fine of $7,500.00 to the Landlord and Tenant Board by October 25, 2025, for egregious misconduct in disregarding the Residential Tenancies Act.
