What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant, who has a permanent eye disability and relies on ODSP income, fell behind on rent after being laid off in 2023. While partial payments were made, the parties agreed on significant arrears. The Landlord expressed a willingness to assist with the move, but argued the tenancy was no longer sustainable for the Tenant.
The ruling
The tenancy is terminated effective November 15, 2025. The Tenant may void the eviction by paying $5,586.00 by October 31, 2025, or $6,586.00 by November 15, 2025. If the Tenant does not void the order, he must vacate by November 15, 2025, and pay the Landlord $5,079.20 plus daily compensation of $32.88 from October 16, 2025, until he vacates.
