What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to meet a condition specified in the mediated settlement signed by the parties on February 2, 2023 with respect to a previous application.
The ruling
The tenancy is terminated effective May 7, 2023. The Tenant must vacate the rental unit by that date. If the unit is not vacated by May 7, 2023, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant must pay the Landlord $12,867.99 (less any amount paid after the application was filed) for rent arrears and the cost of the previous application, less the rent deposit and interest owed on the deposit. The Tenant must also pay the Landlord $30.28 per day for compensation for use of the unit from April 27, 2023 until the Tenant moves out. If the full amount is not paid by May 7, 2023, the Tenant will owe interest at 6% annually on the outstanding balance.
