What happened

Tenants applied for an order determining that the Landlord collected or retained money illegally. The Landlord did not use the Tenant's rent deposit to pay for the last rental period of the tenancy and did not return the deposit to the Tenants, which is prohibited by the Residential Tenancies Act.

The ruling

The Landlord must pay the Tenant Burcu Emec $1,253.00, which includes $1,200.00 for the last month's rent deposit and $53.00 for the cost of filing the application. The Landlord shall pay the full amount by September 15, 2024, and if not, will owe interest at 7.00% annually on the outstanding balance.
