What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit on September 30, 2023, prior to the hearing date.
The ruling
The tenancy between the Landlord and the Tenants is terminated as of September 30, 2023, the date the Tenants moved out of the rental unit. The Tenants shall pay the Landlord $2,043.41, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit. If the Tenants do not pay the full amount by February 3, 2024, they will start owing interest at 7% annually on the outstanding balance.
