What happened
The Tenant applied for an order for the return of illegally retained money after paying the Landlord a last month's rent deposit, first month's rent, and a key deposit. The tenancy, which was supposed to commence in April 2023, was repeatedly postponed. In September 2023, the Landlord informed the Tenant she would not be given possession of the unit and subsequently rented it to someone else without returning the Tenant's money.
The ruling
The Landlord is ordered to pay the Tenant a total of $6,348.00. This amount consists of the $3,000.00 last month's rent deposit, $3,000.00 for the prepaid first month's rent, a $300.00 key deposit, and the $48.00 application fee. The payment is due by June 8, 2025, after which interest at 5.00% will apply to any outstanding balance. The order was made because the Landlord failed to provide vacant possession of the unit after accepting the payments.
