What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant seriously impairing the safety of others and willfully causing undue damage to the premises. The Landlord provided evidence of two incidents where the police were called to arrest the Tenant, resulting in the deployment of a tactical unit. The Landlord also alleged the Tenant had damaged the smoke detector in the rental unit on multiple occasions.
The ruling
The tenancy is terminated effective May 7, 2023. The Tenant must vacate the rental unit by this date. If the unit is not vacated, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant must pay the Landlord $186 for the cost of filing the application. If the amount is not paid by May 7, 2023, the Tenant will owe interest at 6% per annum on the outstanding balance.
