What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to persistent late payment of rent. Evidence provided showed that between September 2024 and September 2025, the Tenant paid rent late 13 times in 13 months. Furthermore, following the service of the N8 notice, the Tenant failed to pay rent for October and November 2025. The Tenant did not attend the hearing to contest the application or provide evidence for relief from eviction.
The ruling
The LTB ordered the termination of the tenancy effective December 9, 2025. The Tenant is required to vacate the unit by this date. The Tenant was ordered to pay the Landlord the $186.00 filing fee and daily compensation of $41.10 until they move out. The Landlord is permitted to apply the rent deposit and interest towards amounts owed. If the Tenant does not vacate, the Landlord may enforce the eviction through the Sheriff starting December 10, 2025.
