What happened

The Landlord applied to terminate the tenancy based on non-payment of rent (L1) and persistent late payment (L2). The Tenants had been late 13 out of 15 months before stopping payments entirely. The Tenants also failed to comply with a previous interim order from the Board requiring them to pay rent while awaiting the hearing. The Tenants raised maintenance issues regarding a stove and garage door as a defense, but provided no evidence and failed to show they informed the Landlord of these issues.

The ruling

The tenancy is terminated effective July 31, 2025, due to persistent late payment and significant rent arrears. The Tenants are ordered to pay the Landlord $30,709.64 for arrears and filing fees. The Tenants must vacate the unit by the termination date; otherwise, the Landlord can enforce the eviction through the Sheriff starting August 1, 2025. The termination is non-voidable.
