What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated unless the tenants pay the outstanding rent arrears of $20,686 by September 30, 2023, $23,086 by October 10, 2023, or $25,486 by November 30, 2023. If the tenants do not pay, they must vacate the unit by October 10, 2023. The landlord is entitled to compensation of $78.90 per day for use of the unit after September 14, 2023.
