What happened

The Landlord had previously obtained an order against the Former Tenant for $3,010.83 for rent arrears and damages. The Tenant requested a review of that order, claiming she was not properly heard and had additional evidence. The review hearing determined that the Tenant's evidence was available at the time of the original hearing but she failed to present it. The Board affirmed that a review is not a second chance to present a case. The Tenant also argued she should not be liable for a month's rent as she moved out due to the Landlord's actions, but it was undisputed that she failed to provide the required 60-day notice. Consequently, the Board denied the Tenant's review request and upheld the original order.

The ruling

The Tenant's request to review the order LTB-L-021908-24, issued on March 27, 2025, is denied. The original order, which requires the Tenant to pay the Landlord $3,010.83, is confirmed and remains in effect. The interim stay of the original order is lifted immediately.
