What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. A preliminary issue arose regarding the validity of the N4 notice because it did not include February 2025 rent, which the Landlord later claimed in the application. The Landlord chose to abandon the claim for February 2025 rent to maintain the validity of the notice and proceed with the hearing. Tenant 1 contested the arrears, claiming payment for March 2025, but admitted that rent for April through August 2025 remained unpaid.

The ruling

The tenancy is terminated unless the Tenants pay $10,686.00 by September 21, 2025. If the Tenants do not pay and do not vacate, the Landlord may enforce the eviction starting September 22, 2025. If the tenancy is terminated, the Tenants are ordered to pay the Landlord $6,693.02, which accounts for rent arrears and the filing fee, offset by the rent deposit and interest.
