What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants did not attend the hearing. While the Tenants made a payment after the application was filed, arrears remained. The Landlord agreed to proceed with a specific arrears figure despite potential accounting discrepancies noted by the Member. The LTB ordered termination of the tenancy unless the Tenants paid the required amount to void the order.

The ruling

The tenancy is terminated effective August 19, 2025. The Tenants may void the termination by paying $1,838.25 to the Landlord or LTB in trust on or before August 19, 2025. If the tenancy is terminated, the Landlord actually owes the Tenants $1,407.03 (after applying the rent deposit and interest), subject to daily compensation deductions of $51.81 for each day the Tenants remain in the unit after July 30, 2025.
