What happened
Landlord applied to terminate the tenancy and evict the Tenant due to persistent late payment of rent and the Landlord's need for the rental unit for personal use by the Landlord's mother. The Landlord initially also applied for compensation for unpaid utilities and undue damage, but withdrew those claims.
The ruling
The Landlord's application to terminate the tenancy for personal use was dismissed as the Landlord's declaration did not comply with the Act's requirements. The Landlord's application to terminate for persistent late payment of rent was granted, but the Tenant was granted relief from eviction on condition that the Tenant pay rent on time for the following year. If the Tenant breaches the condition, the Landlord may return to the Board to seek eviction without further notice.
