What happened

The Tenant applied for an order determining that the Landlord failed to meet maintenance obligations following a sewage flood in August 2023. The flooding resulted in pervasive mould, mildew, and structural damage that remained unrepaired for over a year. The Landlord, who took over management in May 2024, partially started repairs but then ceased all work and closed the maintenance request while the unit was still in significant disrepair.

The ruling

The Landlord is ordered to pay the Tenant $9,889.28 by December 29, 2025. This includes $9,041.28 for a 50% rent abatement from August 20, 2023, to October 31, 2024, $800.00 for the replacement of a destroyed mattress, and the $48.00 filing fee. The high abatement reflects the substantial and pervasive nature of the sewage-related disrepair and mould which the Landlord failed to address effectively.
