What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and the Landlord's good faith requirement of the rental unit for personal use. The Landlord served the Tenant with a valid N4 Notice for non-payment of rent and an N12 Notice for personal use, but the Tenant did not void the notices by paying the rent arrears or vacating the unit.
The ruling
The Landlord's L2 application based on the N12 Notice is dismissed as it was filed more than 30 days after the termination date. However, the Landlord's L1 application based on the N4 Notice for non-payment of rent is granted. The tenancy is terminated unless the Tenant pays $17,936 by December 16, 2023 to void the order. If the Tenant does not pay, they must vacate the unit by December 16, 2023 and pay the Landlord $14,618.56 plus daily compensation.
