What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant, who is on a fixed income, admitted to the arrears but contested the Landlord's filing costs, arguing the Landlord should have 'pushed' him more to pay before legal action. The Landlord countered that previous payment plan attempts had failed. Both parties eventually agreed to a long-term repayment schedule.
The ruling
The Tenant is ordered to pay the Landlord $966.00 for rent arrears and filing costs. Eviction is stayed provided the Tenant follows a repayment plan of $31.00 per month starting December 1, 2025, through July 1, 2028, and continues to pay current rent on time. If any payment is missed, the Landlord may apply for an immediate eviction order under Section 78.
