What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One of the tenants, Cheryl Beyer, had vacated the rental unit prior to the hearing.

The ruling

The tenancy is terminated unless the tenant pays $26,186 by June 24, 2023 to void the order. If the tenant does not pay, they must vacate the unit by June 24, 2023 and pay the landlord $20,968.39 plus daily compensation of $92.05 from June 6, 2023 until the date they move out.
