What happened
The Landlords applied for termination and eviction based on rent arrears. The Tenants admitted to the arrears but explained financial hardships due to job loss. Tenant 1 recently secured a full-time position, and both tenants expressed a willingness and ability to pay through a proposed payment schedule. The Member found that eviction is a remedy of last resort and granted relief from eviction subject to a conditional payment plan.
The ruling
The LTB granted the Tenants relief from eviction. While the Tenants owe $4,199.21 in arrears and costs, they are permitted to maintain their tenancy provided they adhere to a strict payment schedule ending in January 2026 and pay current rent on time. Failure to meet any payment allows the Landlords to apply for an ex parte eviction order under section 78.
