What happened
Tenant applied for remedies alleging illegal entry, lock alteration without keys, and harassment. The most significant allegation involved the Landlord removing the rental unit door from its hinges to change a lock. The Landlord argued they provided notice of entry to 'examine' the door and lock but admitted to removing the door during the process. Other allegations regarding harassment, towing of a vehicle for unpaid parking, and verbal threats were dismissed due to lack of evidence or findings that they did not rise to the level of harassment.
The ruling
The LTB found the Landlord entered the unit illegally by removing the entrance door from its hinges to change a lock, an action deemed egregious. The Tenant was awarded a $2,000.00 rent abatement and the $48.00 filing fee. However, because the Tenant owes $24,955.66 in rent arrears from a previous order, these awards are to be offset against that debt, meaning the Tenant still owes a significant balance to the Landlord.
