What happened
The Landlord filed an application to evict the Tenant for non-payment of rent. The Tenant contested the amount of arrears, claiming he had performed construction work for the Landlord in lieu of rent. The Board found the Landlord's evidence more credible and determined the rent arrears to be $9,294.50. Despite this, the Board exercised its discretion under section 83 of the RTA to postpone the eviction, considering the Tenant's long-term residency, community ties, and the hardship an immediate eviction would cause.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the full amount owing. The Tenant can pay $12,043.00 by June 30, 2025, or $14,605.50 by July 31, 2025, to continue the tenancy. If the Tenant fails to pay and does not move out by July 31, 2025, the Landlord can enforce eviction. If the tenancy is terminated, the Tenant must pay the Landlord $6,415.83, plus daily compensation of $84.25 from May 27, 2025, until moving out.
