What happened

The Landlords applied to terminate the tenancy because they required the unit for their son, a university student, to live in for at least one year. The Tenant contested the application, alleging bad faith due to the Landlord's previous attempts to sell the unit, financial motivations related to interest rates, and a previous request for the Tenant to sign an N11 agreement. The Tenant also suggested the application was retaliatory following maintenance requests.

The ruling

The LTB ordered the termination of the tenancy effective August 31, 2025. The Landlord successfully demonstrated that their son genuinely intends to occupy the rental unit for at least one year for university studies. The Board dismissed the Tenant's arguments of bad faith and retaliation, finding the son's testimony credible. The Landlord has already provided the required one-month rent compensation.
