What happened
The Landlord applied to terminate the tenancy and evict the Tenants because they have been persistently late in paying rent. The evidence showed that the rent was paid late 28 times in the 28 months leading up to the notice. While the Landlord sought termination, the Tenants requested relief based on changing financial circumstances including new employment stability.
The ruling
The LTB issued a conditional order. The tenancy continues provided that from November 1, 2025, to October 1, 2026, the Tenants pay the lawful rent on or before the first day of every month. If the Tenants fail to pay on time during this period, the Landlord may apply for an eviction order without notice to the Tenants. The Tenants must also pay the Landlord $186.00 for the application filing fee by October 26, 2025.
