What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant following a violent incident in the rental unit. Evidence presented at the hearing indicated that the Tenant was arrested and charged with second-degree murder after a stabbing occurred at the premises on October 28, 2024. The Tenant is currently incarcerated. Other residents of the complex expressed significant concerns regarding their safety following the incident. The Landlord sought an expedited eviction order, which was supported by police testimony regarding the severity of the criminal charges.
The ruling
The LTB ordered the termination of the tenancy effective May 25, 2025, due to the Tenant's involvement in a second-degree murder incident within the residential complex. The Tenant was ordered to vacate by that date, with the Sheriff directed to expedite the eviction process starting May 26, 2025.
