What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant was served a valid N4 notice but did not void it by paying the arrears. The Tenant disputed the amount of rent owing and claimed to have paid in cash, but could not provide any evidence.
The ruling
The Landlord's application to terminate the tenancy and evict the Tenant for non-payment of rent is granted. The Tenant may void the order by paying $24,936 by February 29, 2024 or $25,686 by March 4, 2024. If the Tenant does not void the order, the Tenant must vacate the unit by March 4, 2024 and pay the Landlord $23,682.60 in rent arrears and application fees.
